New fireworks law: What's legal and what's not

Posted: Updated:
PHOENIX (KSAZ) - It might be easier to understand, but some of the boom and sizzle are gone from these tents where fireworks are sold. No firecrackers are sold; it's illegal to sell them, skyrockets, bottle rockets, and aerials are not permitted. The law is much clearer.

If you buy it here in Maricopa County, you can set it off in Maricopa County, on private property, without breaking the law.

Phantom Fireworks operates some 32 tents across the valley and in Tucson. Owner, Steve Lurkey says the new law, though it takes some things off the table for sale like firecrackers, it might actually be good for business.

In the past years, the Arizona law governing fireworks use was cloudy he says, and people were confused.

"That stopped a lot of people from buying because they were afraid they were going to get picked up by police and get a citation, now you can use them," said Lurkey.

You can legally use them until July 6th, and then legally use them again between Dec 24th to Jan 3rd.

When you do, Phoenix Fire is asking people to be safe.

"If you're gonna use them we're telling people to have adult supervision, make sure there's some sort of water supply, and do it away from combustibles, so you don't catch anything on fire," said Brian Scholl with Phoenix Fire.

Scholl says don't be lulled into thinking permissible means safe.

"Just because permissible fireworks are allowed they're still very dangerous, they burn very hot, and easily catch clothes on fire causing severe burns," he said.

Lurkey said he hopes to have a good year sales-wise because the fourth falls on a Friday, and people will be in a party mood for the weekend. If you notice a price bump, Lurkey says on the bigger packages over $75 they increased prices because of labor costs in China. 98% of the fireworks are made in China.

Heavy thunderstorms swept through the tri-state on Sunday causing flash floods and lightning strikes that injured 3 people. The three men were struck at Orchard Beach in the Bronx Sunday afternoon and were being treated at a local hospital. Meanwhile, various Labor Day weekend celebrations were interrupted, delayed and even canceled as the U.S. Open tennis tournament had to be postponed and the Electric Zoo musical festival on Randall's Island had to be prematurely shut down.
