Who was out of order? Judge Joe Brown or magistrate?

Judge Joe Brown is out of jail on his own recognizance.  But the question remains, who was out of order when Brown was thrown in jail on contempt of court charges?

FOX13 News spoke with former judge and FOX13 Insider Judge D'Army Bailey about the incident.

"A judge has the right to maintain in his courtroom," said Bailey.

As retired Judge Bailey knows, the person on the bench calls the shots. A judge is to be neither chastised nor angered.

Judge Brown did both if you listen to the audio tape of the confrontation between him and the magistrate at juvenile court.

"He has the statutory authority in juvenile court to imprison up to 10 days and a $50 fine."

Judge Bailey listened to the audio tape and said, "Well, if you push, you push in peril and you're in shackles."

Statement from Juvenile Court Judge Curtis Person:

"Anyone who comes before the Juvenile Court of Memphis and Shelby County will be treated fairly, with dignity and with respect. Anyone who acts in a contemptuous manner toward this Court, toward any member of this Court, toward any employee of this Court or toward any visitor of this Court will be dealt with appropriately according to the laws of the State of Tennessee."
