Detroit police re-issue traffic ticket to George Cushingberry

(WJBK) -

George Cushingberry Jr.'s traffic citation which was recently dismissed will be re-issued, Capt. Anthony Topp of the Detroit Police tells FOX 2's M.L. Elrick.

The ticket was dismissed when no Detroit police officer appeared in court. Chief James Craig explained on Friday that officer was assigned to a new precinct and the subpoena was mailed to his old post.

However, Elrick discovered the officer had been working at the new precinct for months before the ticket was issued. Police are now saying they don't know where the notice to appear in court was sent.

The court says it did generate the notice to appear and that it was left for the police.

Alcohol and marijuana were found in Cushingberry's vehicle during the Jan. 7 stop. Cushingberry was ticketed for failing to signal a turn.

The outcome of the traffic stop raised concerns that Cushingberry may have been given preferential treatment. The Detroit Police Department launched an internal investigation into the matter and determined Cushingberry may have received preferential treatment.

Cushingberry has been unavailable for comment. He has said he was not intoxicated and was racially profiled.

A new poll conducted by Quinnipiac University found overwhelming opposition to the way the arrest of Eric Garner was handled while the majority support the broken windows policy, which cracks down on low-level crimes to prevent bigger ones from occurring. Garner's death has brought the policy into the spotlight. The Staten Island man had been selling untaxed cigarettes when he was arrested. A police officer placed him in a chokehold and Garner died.
