MELBOURNE, Fla. (WOFL FOX 35 ORLANDO) -

Melbourne police say a man is in trouble with the law after he deliberately sunk his girlfriend's car in the Indian River.

Police say Kenneth Smith, 26, is facing charges of Criminal Mischief and Trespassing after sinking his girlfriend's car after they had a fight.

Police say Smith sent his girlfriend, who is a soldier stationed in South Korea, a text message saying, "Good luck finding your car."

That's when investigators say he drove it to 840 S. Harbor City Blvd. in Melbourne, put the 2011 Chevrolet HHR in neutral and watched as it rolled into the water and sunk.

A witness could 911 at around 7 a.m. Saturday.

"I was afraid that someone was in the vehicle," said John Tallman. "And there was a person standing there at first, and in an instant he was gone."

The City of Melbourne said Smith damaged a chain link fence and two gates --- an estimated $600 in damage.

As for the car, Police say it was a total loss and has been recovered from the water.

It's value is estimated at more than $10,000.

The woman told police she planned on pressing charges against Smith.
