Father Fights To Stay In Country To Care For Sick Child

A father is fighting to stay in the country while his baby boy is in potential fight for his life. The dad is an undocumented immigrant. His three young children were born in the states including a 7-month-old son who was in critical condition at the hospital last week.

FOX 29's Thalia Perez spoke to the infant's mother.

The baby boy is just 7 months old and during his short life so far he's suffered from some serious health conditions. Both mom and dad have tried everything to keep their family together here in the U.S. but still their future is hanging in the balance.

Meet Emily Navas, her boyfriend Carlos Oliva-Guillen and their baby boy Jen Carlos during happier times.

"I've been in that room with four walls 2 weeks straight. The first time I got out was yesterday to take Carlos' daughters to say goodbye." Emily Navas said

Now Oliva Guillen who is an undocumented immigrant is separated from his family and awaiting deportation back to Honduras, but their son who is only 7-months old is dealing with critical health issues. He was previously - hospitalized for MRSA, he suffers from hypoglycemia and is currently being treated by doctors at CHOP after he suffered a seizure two weeks ago.

"My heart dropped. I saw my son plugged up to a lot of machines. I couldn't even sleep. I was looking at him crying," Emily said.

That was the moment she says she realized they would probably never be a family again at least in the U.S. unless they won a humanitarian appeal and that process could take a long time.

Her attorney Matthew Archambeault tells us the couple's request for temporary stay was denied.

"We weren't asking for him to become a permanent resident. We were asking if he could be released to help care for his infant son," Archambeault said.

Carlos has two other U.S. born children from a previous relationship ages 6 and 5. His attorney says he doesn't have a criminal history and was gainfully employed when he was picked up by ice.

Oliva-Guillen was born in Honduras and arrived in New Jersey after crossing the Texas border ten years ago.

Navas is from Guatamala but is legally living in the U.S. She says the two never rushed to get married because the terms of her residency would not have changed his immigrant status. She tells us they were both working to save money to move into a new place. Now those dreams have been shattered.

The thing that hurts me is my son couldn't say good bye to him because he was in the hospital," Emily said.

Update: Baby Jen Carlos has now been discharged from CHOP and although he will have to go back for more tests. He is back home with her in New Jersey.
