Landfill Drama Continues To Stink

Roxbury, New Jersey (My9NJ) - The controversy continues in Roxbury, New Jersey at the Fenimore Landfill and people don’t understand why local residents can’t get any help, but new developments show that there may be more to the whole story than originally thought.

Richard Bernardi, the owner of the Fenimore Landfill, which has now been taken over by the DEP, recently filed an ethics complaint with the state claiming “to have been on the receiving end of some real political retribution from, Governor Chris Christie’s administration”.

Bernardi’s attorney Matthew M. Fredericks discussed his client’s position.

“We think it’s consistent with a lot of the things that are now coming out in the news about the way this administration does business,” he explained.

Bernardi and his legal team feel that there is a glaring conflict of interest in their case. You see, the previous DEP Deputy Commissioner Irene Kropp’s husband owns the Stag Leap Landfill in Mullica Hill that competes directly with Fenimore.

“As everyone knows the SEP received a tipping fee for the fill material that it received just as Irene Kropp’s husband’s landfill received a tipping fee. Therefore, they’re essentially business competitors,” Fredericks explains.

The DEP claims that there is no conflict of interest and that Kropp had recused herself from the Fenimore case, except for during a November 29th 2012 visit she made there. Ironically, the landfill was taken over by the DEP shortly after that.

As a result, Bernardi filed an OPRA request of all of Kropp’s emails and paperwork relating to Fenimore Landfill which uncovered in 97 documents that Bernardi’s legal team is currently looking through.

Kropp retired six-months after the ethics complaint was filed against her.

Since the DEP has taken over the landfill, the toxic gas being emitted from Fenimore has not improved at all and residents are still up in arms.
