Charles Pugh will not face charges for alleged misconduct with teen

Former Detroit city council president Charles Pugh will not face charges after being accused of having inappropriate contact with a teenager. He was facing a fourth-degree criminal sexual conduct charge, that could have led to a fine and possibly two years in jail.

Assistant Oakland County prosecutor Paul Walton says no evidence supports any criminal wrong doing. "We're bound by the law. We can't prosecute a case based on emotion, what we feel may have happened, we have to go by what the evidence is that we have," says Walton.

Pugh left the city council unannounced and disappeared around the same time the accusations surfaced. He later officially resigned from his position in September, maintaining he did nothing illegal.

But what Oakland County prosecutors say happened is enough to raise eyebrows. Pugh had just taken the 18-year-old male student shopping. Afterward they were together, alone, in a car.

"The investigation ultimately boiled down to what had occurred in that car. And, in the car, he stated he placed his hand on his thigh and that he immediately rebuffed the advance, and after it was rebuffed there was no further action on the part of Charles Pugh," Walton says.
 
But is there more?

Sources tell Fox 2 Pugh sent several sexually charged text messages to the student, many of which were extremely graphic. Even so, Oakland County prosecutors say the texts could not bolster their case.

Walton explains, "That, again, isn't anything we can prosecute in Oakland County and, quite frankly, they were text messages between two adults."

"I trust him wholeheartedly. There's no doubt in my mind that my child is with a safe individual," Mary Williams tells Fox 2's Randy Wimbley. Pugh mentored her son. She was relieved upon hearing the prosecutor's decision and is convinced Pugh is not a sexual predator.

Even so, he's not in the clear either.

Bill Seikaly, the attorney representing the student's family, says the prosecutor's decision has no impact on civil litigation.

Fox 2's legal analyst Charlie Langton explains, "Just because there's no criminal charges against Charles Pugh doesn't mean that you can't have a civil case against Charles Pugh." He continues, "But in reality, though, what are you going to get from Charles Pugh? I understand he doesn't have any money, and the proof - you still have to prove he did something and he caused some damage to this kid."

But sources tell Fox 2 as more details emerge about what happened between the two, it would be very embarrassing for the young man involved and will tarnish what's left of Pugh's reputation in Detroit.
