DETROIT (WJBK) -

Wayne County Prosecutor Kym Worthy plans to announce Friday morning whether she will seek charges in the death of Renisha McBride in Dearborn Heights.

McBride, 19 of Detroit, was killed by a shotgun blast to the face on Nov. 2 on the porch of a Dearborn Heights home.

The man accused of killing her told investigators that he thought someone was trying to break into his home and accidentally discharged the gun, according to police.

A toxicology report released Thursday showed she had a blood-alcohol content of 0.22 and marijuana in her system.

The reports provide some information about the circumstances of a shooting in which few details have been made public. But Gerald Thurswell, the McBride family's attorney, said the toxicology report has no bearing on the case as far as he's concerned.

"Let's assume she was drunk. Does that give anybody the right to take a shotgun and blow her head off?" asks Thurswell. "That's an excuse. It's not a justification."

On Friday at 11:00 a.m., Wayne County Prosecutor Kym L. Worthy will hold a press conference to announce if any charges will be filed.

Under a 2006 Michigan self-defense law, a homeowner has the right to use force during a break-in. Otherwise, a person must show his or her life was in danger.

The shooting has prompted calls for a thorough investigation from civil rights groups that say race was a factor. McBride was an African-American.
