The Mike Duggan campaign is accusing labor activist Robert Davis of trying to pull off a "pre-election stunt" to influence the outcome of tomorrow's vote for Mayor of Detroit. Davis wanted Duggan to testify on his role in the selection of an emergency manager in Detroit, but the court ruled Duggan did not have to appear on Monday.
 
Lawyers for the state and Duggan wanted the court to toss out the suit describing it as "a political stunt." Those are the words of attorney John Pirrch. He told the judge Davis was trying to influence the mayoral election during the eleventh hours. "To file a lawsuit on the Thursday before the election and schedule without any communication a deposition of a mayoral candidate is outrageous. Plain and simple, outrageous," Pirrch continues.  

But the Davis attorney told the judge voters needed to know what Duggan said, as outlined in a series of emails with the governor's office on the emergency manager issue.

"Mike Duggan is Governor Snyder's hand picked candidate not only for mayor of the city of Detroit but he was also his candidate for emergency manager," Davis says.

"The email show Mike Duggn - didn't have anything to do with the selection of the emergency manager - asked for it's delay," says Butch Hollowell, Duggan's attorney. Hollwell tried to draw a link to Davis' support for challenger Benny Napoleon: "I think it is self evident. I think its transparent. This is transparently political."

Davis maintains he did not file directly or indirectly on behalf of Napoleon.

The judge ruled Duggan did not have to testify Monday and, by waiting so long to file the suit, the judge concluded Davis was trying to create an emergency that the judge was not buying.

    Emergency personnel are responding to falling debris from a high-rise building in Midtown Manhattan. West 57th St. between 5th and 6th Avenues is closed. SkyFoxHD was overhead where pieces of glass could be seen on the ground and a window shattered. Two people were hit by the falling glass at about 8:45 a.m. and were taken to Roosevelt Hospital with minor injuries, according to police.

    Two thugs were caught on security camera footage beating a teenager and stealing from her inside an apartment building in the Midwood section of Brooklyn.  The NYPD says the attackers are seen dragging the 18-year-old out of an elevator into the hallway and punching and kicking her.
