Doody jury: 'We have reached an impasse'

PHOENIX -

Jurors in the retrial of a man charged with killing nine people at a suburban Phoenix Buddhist temple in 1991 told their judge Wednesday they have reached an impasse.

After several stops and starts over nearly seven days of deliberations, the judge asked the panel Wednesday morning to let him know if they were at an impasse -- which they later did in a note.

The note apparently blames one juror for the impasse. The judge sent the jury home and it's possible he may declare a mistrial on Thursday.

Last week, the judge considered declaring a mistrial after jurors told him one juror was refusing to participate. That juror said she had already made up her mind. The judge then ordered the jury to continue trying to reach a verdict.

Johnathan A. Doody was convicted in 1993 and sentenced to 281 years in prison. An appeals court overturned his conviction, ruling that he wasn't properly read his rights.
