Dead inmate subject of Arizona Supreme Court case

PHOENIX (AP) - An Arizona inmate who died without having his appeals resolved has become the subject of a case before the state Supreme Court.

Maricopa County Superior Court Judge Joseph Welty dismissed the indictment against Richard Glassel after his death in January from apparent natural causes.

The Arizona Capitol Times reports that county prosecutors have asked the Arizona Supreme Court to nullify that decision and keep Glassel's criminal record intact.

Glassel's victims also are seeking to have the legal precedent that Welty used to reach his decision abolished.

The court heard arguments in the case earlier this month.

Glassel had been convicted on two counts of first-degree murder and multiple counts of attempted murder following a shooting at a homeowners' association meeting in Peoria in 2000.

He was imprisoned in Florence.
