Kid Suspended After Pretending Hand Gun Gesture

A game of cops and robbers ended in a suspension for an elementary school student in Florida, after he pretended his hand was a gun.

Third grader Jordan Bennett just got suspended after playing cops and robbers at school. His mom, Bonnie Bennett, claims the principal suspended the eight year old for using his thumb and index finger to pretend his hand was a gun. Tuesday night she took her case to the Osceola County School Board.

"I am asking that his situation be thoroughly investigated and it be brought to the board for the next meeting," Bonnie said.

Jay Wheeler, School Board Chairman said, "This should have been handled differently. I appreciate you being here and I appreciate you working with staff."

Bennett talked to the principal Tuesday. She believes he did not have all the information Friday when he decided to suspend Jordan. Bennett claims her son was playing a game.

"He needs to be taught a lesson based on that, not the fact that it is construed as a violent act because it's not. There was not intent to harm, " Bennett said.

Bennett wants the school board to remove the suspension from his record.

"It was inappropriate I agree with that. But this punishment is absolutely excessive, " Bennett said.

A spokesperson for Osceola County Schools says she cannot comment on specifics of this case due to confidentiality rules. She says punishments are up to the discretion of principals. They look at all the factors involved in a situation and make a decision based on the code of student conduct book.

Bennet said, "I cannot find anything, any reference whatsoever to finger pointing or using your finger as a gun in the code book. I cannot find anything on it at all."

Jordan's mother said she hopes the school board will consider her son's case for their next meeting. In the meantime she's hired an attorney.
