Police: Teenager won't be charged in "unfortunate accident"

LAKE ORION, Mich. (WJBK) -

The Village of Lake Orion Police Department responded to a pedestrian accident on M-24, near Heights Road, Sunday evening. The accident involved a 17-year-old male striking a 60-year-old male with his vehicle.

Police say the victim entered the road and the driver could not avoid hitting him. Toxicology reports are pending, but police believe the victim was under the influence of alcohol, and his family fears he also was taking medication from a recent dental surgery. Preliminary reports suggest the driver was not speeding, and the victim fell into the path of the vehicle while picking up a spilled case of beer. Police are calling it an "unfortunate accident" and no charges are pending against the driver at this time.

"I feel horrible for that 17-year-old kid. To live with it forever, and it was an accident," Amber Kyle, the victim's niece, tells Fox 2's Maurielle Lue.

Lake Orion Police Chief Jerry Narsh adds, "It's always difficult to be a participant in a situation like this, but everyone stopped and did everything they could to save this man's life. And just unfortunately, that didn't happen."
