Lawyer: Appointed senator will prove residency

PHOENIX (AP) - The lawyer for a newly appointed state senator says he will provide proof to Apache County officials that his client is legally allowed to represent the state's 7th legislative district.

Phoenix attorney Andrew Gordon says critics of Democratic Sen. Carlyle Begay's appointment are misreading the residency requirements in election law.

Rep. Albert Hale's lawyer has challenged Begay's right to the seat because he's lived for more than 7 years in Maricopa County. They say state law requires a year of residency in the county before a person can represent that area in the Legislature.

Gordon said Wednesday the law requires a year's residency to seek election, but only requires residency at the time for appointment in those cases.

The Apache County Attorney has demanded proof that Begay meets residency requirements.
