Armed Genesee Co. moviegoer accused of having fake CIA badge

It took moviegoers by surprise Tuesday night when they saw 24-year-old Cassidy Delavergne sitting next to them in Grand Blanc Township's Trillium Cinema wearing body armor and armed with a gun. They let management know, who called police.

When officers approached Delavergne, we were told that he flashed a phoney CIA badge and told them he was an agent. He happened to be watching "Red 2" at the time, a movie about CIA agents.

"He was lawfully allowed to possess a firearm by the State of Michigan and by Second Amendment protections. The constitution says you have a right to bear arms," said Jeff Clothier, Delavergne's attorney.

"What about the fake CIA badge?" I asked.

"It was a costume," he said.

However, police were suspicious of his story, arrested Delavergne and searched him. With his nine millimeter weapon he had 34 rounds of ammunition and 111 rounds in his car.

Genesee County Prosecutor David Leyton said because Delavergne is a CPL holder, technically he did not do anything illegal.

"It's really strange. It's really odd, and he very well might be a threat. I don't know. But he didn't commit any state offenses. He did commit a federal offense by virtue of having the fake CIA ID," he said.

So the feds charged him with possessing a false government credential.

Delavergne may not have been considered a threat, but Leyton, who also sits on the gun board, said a federal indictment was enough to revoke his CPL.

We tried to talk to NCG Cinemas about their policies, how this was handled and how they plan to handle situations like this in the future, but all we got was the following prepared statement.

"Our employees and onsite security notified the local authorities so a resolution could be achieved in a quick and calm fashion."

We found out this was not the first time Delavergne has impersonated an undercover officer.

He did not answer the door at his Genesee Township home, but his neighbor claimed he has even offered his services as a police officer.

"He was undercover, yeah, he was a police officer," Malik Thompson said Delavergne told him.

His attorney claimed the 24-year-old, who works for a software company, is not dangerous, just a man who made a bad choice, and they plan to fight the charge.
