Courtroom Audio Sheds Light On Fight To Save Sarah's Life

PHILADELPHIA -

A 10-year-old's fight for new lungs helps get a temporary win for another child.

We've been reporting on how this week, after a long battle, Sarah Murnaghan got the news her family has been waiting for – the possibility of new lungs!

A judge ruled Wednesday that, for the next 10 days, Sarah will go on the adult transplant list.

Now, an 11-year-old boy has been placed on the list, also on orders from a federal judge.

It took an emergency hearing Wednesday afternoon to make it all happen.

Current organ donation policy states that a potential recipient must be 12 years or older.

So, the judge issued a temporary restraining order that suspends the "under 12 rule."

Courtroom audio obtained by FOX 29 News has Judge Michael Baylson saying, "She might be dead! And that would be a terrible tragedy. So that's another reason, a very practical reason. In my view, it's a better exercise of my discretion to grant the TRO (temporary restraining order), to do so and to do it right now."

It's possible that the organ transplant network that makes the rules will decide to change the policy at an emergency meeting scheduled for Monday.

We're told that the boy being added to the adult list is in desperate need for a lung as well, but not quite as desperate as Sarah.

FOX 29's Claudia Gomez has more courtroom audio in this video report, including the arguments made by lawyers for Sarah's family on her condition and how they argued the organ donation policy constitutes age discrimination.
