An officer-involved shooting early Saturday morning left one man dead and another in very bad shape in a hospital. The Phoenix Police officer was not hurt.

A rapid-fire string of gunshots rang out at 4 a.m. outside the Hurricane Bay club at 41st Avenue and Bell Road.

"I looked out my window, did not see anything until my husband came home and saw cops everywhere, right next to my place," said April Gunn, who lives nearby.

Phoenix Police say one of their officers was working off-duty at the club.

Around 4 a.m., the officer and two employees were leaving when they saw two men trying to steal a small refridgerator in the bed of his white truck.

According to Sgt. Tommy Thompson, 19-year-old Jose Luis Chacon and a 28-year-old man immediately jumped into a waiting SUV and pointed guns at the other men as they ran after them.

The officer identified himself and told the suspects to drop their weapons, but they ignored him.

In an effort to protect himself and the other two men, Thompson says the officer fired multiple rounds at the suspects.

One of the night club employees had a handgun and also started shooting because he believed the suspects were firing at him.

The driver, 24-year-old Tomas G. Ramirez Gonzalez, parked the SUV and collapsed a short distance away. Thompson says he died at the scene.

The officer ordered the other two suspects out of the SUV and they complied. Assisting officers helped take the men into custody.

The 28-year-old man was taken to a hospital with critical injuries. Chacon wasn't injured.

Phoenix Police stress that the off-duty officer in this exchange of gunfire was very, very fortunate that he was not hit. He is on administrative leave, which is standard procedure in officer-involved shootings.

Thompson says Chacon admitted to shooting a rifle during the incident.

He was booked into jail and charged with 1st degree murder during the commission of a crime and numerous other felony crimes.

Detectives found two handguns and two rifles inside the SUV and are continuing to investigate.

Phoenix police say the 43-year-old officer involved has been with the department around 20 years.
