New Lake County prosecutors vacate old conviction

CHICAGO (FOX 32 News) -

A hearing to vacate the aggravated battery conviction of a Chicago man who spent 20 years in prison will be held Friday.

Bennie Starks was in prison for two decades before DNA evidence suggested he did not commit the 1986 rape of a Waukegan woman.

The Lake County State's Attorney announced he would dismiss the aggravated battery charges.

He has been free on bond since 2006 when an appeals court ordered a new trial.

Starks attorneys are also trying to get a battery conviction vacated.
