HUDSON, Wis. -
The father accused of killing his three young daughters at the girls' western Wisconsin home is back in court.
Among the issues addressed during Aaron Schaffhausen's hearing in St. Croix County Circuit Court Monday was a 3-hour-and-20-minute videotaped police interrogation -- and whether or not jurors may be able to see all of it.
According to testimony heard in court, Schaffhausen -- who has stayed silent during the duration of the trial so far -- did react during that interview with police by breaking down into tears when an investigator said tucking the dead girls into their beds is something a father would do.
Yet, the investigator also acknowledged that Schaffhausen sat silent for most of the interview -- at one point, for over two hours straight.
This raises a question of whether or not Schaffhausen waived his rights or not -- and whether the contents of the video are admissible for the prosecution to use in order to suggest Schaffhausen is guilty and fully aware of what happened.
The 35-year-old carpenter from Minot, N.D., is accused of killing 5-year-old Cecilia, 8-year-old Sophie and 11-year-old Amara Schaffhausen at their home in River Falls last July during a visit with his daughters.
Also on Monday, the prosecution called a Schaffhausen's chemistry professor at River Falls as a witness. She told the court he was upset in January because his wife had a boyfriend in Illinois he called a "sugar daddy."
She characterized alsoSchaffhausen as intelligent, organized, meticulous and a planner. Prosecutors claim that shows he certainly could he understood a Miranda warning.
The Star Tribune reports the home owned by Schaffhausen where the girls died is now in foreclosure.
