Family of cop shooting victim speaks with DA

The mother of an unarmed National Guardsman who was fatally shot by police during a traffic stop has met with the Queens prosecutor.

Cecilia Reyes spoke to the media Thursday after meeting with District Attorney Richard A. Brown.

Reyes said she wants "justice" for her son, Noel Polanco, 22.

She remembers him as a "beautiful child" who never caused problems.

"I assured them that our investigation is active and ongoing and that it will be completed as expeditiously as possible," Brown said. "I pointed out, however, that the investigation is still in its early stages. I told them that when we conclude our investigation I expect that we will present all of the facts to the grand jury." 

The prosecutor's office said the case will likely go before a grand jury.

Polanco was shot by Detective Hassan Hamdy last week. No weapon was found in Polanco's car.

The detctive's lawyer said Hamdy fired after he saw Polanco reaching under his seat. He said Polanco didn't comply with Hamdy's orders to put his hands up.

A front-seat passenger in Polanco's car disputed that account, saying Polanco had no time to comply.

Speaking Monday before the Columbus Day Parade, NYPD Commissioner Ray Kelly said a grand jury will have to "determine precisely what happened there."

He said police investigators can't interview Hamdy until prosecutors complete their probe of the incident.

"Not all cases actually go before the grand jury, but this case I believe needs to go before the grand jury," Kelly said Thursday, the AP reported.
