The "punch seen 'round the world" - the viral video of a Philadelphia policeman col-cocking a 39-year-old Chester woman- appears to be unprovoked, not part of a scuffle that gets out of control.
The incident has lots of folks asking whether the former police Lt. Jonathan Josey could be hit with criminal charges.
The district attorney is expected to consider that question beginning next week.
Aida Guzman and her lawyers emerged from her private meeting with the mayor satisfied with his second apology in two days, but the Chester woman remains gun-shy.
Would she want to come back to Philadelphia? No, said Guzman, "I'm scared."
The now infamous video of police Lt. Jonathan Josey punching Guzman in the face near the Puerto Rican Day parade led to Josey's firing.
But were his actions criminal- is this an assault?
Guzman's lawyer, Enrique Latoison said Friday, "If the district attorney's office feels that those acts were so out of his realm of duty that it constitutes a crime, and they want to speak with us, we will cooperate with their investigation and we will go forward. I can say as a citizen- as a regular citizen who's a non-police officer, if you or I do that, it's a crime. There's nothing else about it- it's a crime."
Mayor Nutter has described himself as "outraged" over actions he calls "appalling" and "horrific."
But again Friday, he declined to call this sucker-punch "criminal."
"I'm not going to venture an opinion about that," he said. "I'm going to leave that to the judgment of the person whose responsibility that is-- and that's the district attorney."
But several dozen city hall demonstrators have no such reservations. They called for Josey to be arrested.
The Fraternal Order of Police says a full investigation may show there is less to this video than it appears. The FOP has already filed a grievance on Josey's behalf- the first step in the months-long process to overturn his firing.
And if he gets his job back?
"We're gonna riot," said Damaris Martinez of North Philadelphia.
"We're gonna riot here in Philadelphia, because he deserves to go to jail for what he did."
Clearly, any successful criminal prosecution of Josey would make it much tougher for him to win back his job. But that's down the road. For now, the district attorney will have to decide whether to charge him with a crime.
