Murder charges stand for Patrick Mikes Jr.

SOUTHFIELD, Mich. (MyFox Detroit) -

Judge William Bolle announces the Patrick Mikes Jr. case will proceed on charges of open murder after hearing from the defense.

The defense was hoping to get Mike's Jr.'s charges lessened, arguing all the evidence in the case should be suppressed because the search of the father's home was done illegally this summer. They also said a consent form was not signed letting officers search the home officially.

However, the prosecution argued that a garbage bag plus the smell of blood in the basement was enough to start a search before getting a warrant.

The defense also argued that there was no pre-meditation showed in the case, and that this could have been self-defense. But in the end, Judge Bolle disagreed and said they can move forward on this case on charges of open murder.

The date is still pending for when Patrick Mikes Jr. will be arraigned.
