Urban Outfitters seeks transfer of trademark case

FLAGSTAFF, Ariz. (AP) - Urban Outfitters Inc. and other defendants in a case alleging trademark infringement say moving it to Pennsylvania where their corporate headquarters are located would be in the best interest of justice.

The Navajo Nation sued the corporations in February, alleging they violated trademarks on the Navajo name that cover clothing, footwear, textiles, online retail sales and household products.

The lawsuit seeks monetary compensation and an order permanently enjoining Urban Outfitters from using the name "Navajo" or variations of it on its products.

The case is pending in U.S. District Court in New Mexico.

Defense attorneys recently argued in court documents that eastern district of Pennsylvania is more convenient and has handled more intellectual property matters. They also cited case volume in saying the lawsuit would move ahead quicker in Pennsylvania.
