Posted: Updated:

HEMPSTEAD, N.Y. (AP) - A New York City man is accused of leaving his young daughter in the car while stealing clothing from a Long Island department store.

Police say Eric Midyett of Queens broke the toe of an officer while resisting arrest.

He was arraigned Sunday on charges of assault, resisting arrest and endangering the welfare of a child.

According to Newsday, Midyett set off alarms while exiting the Burlington Coat Factory in Massapequa with a bag of stolen clothing.

Police say he struggled with police as they tried to handcuff him. An officer was treated for a broken toe.

They say he had left his 9-year-old daughter in the car. She was released to her grandmother.

Information on his lawyer wasn't immediately available.
