Aggravated circumstances found in 2001 murder case

PHOENIX (AP) - Jurors have found aggravated circumstances in the case of a former Arizona death row inmate convicted for the second time in the 2001 murders of his wife and stepchildren.

Maricopa County prosecutors say the penalty phase of David Lamar Anthony's trail will begin Wednesday.

The 64-year-old Anthony was convicted Aug. 28 on three counts of first-degree murder in his re-trial.

He had been convicted in 2002 of murdering Donna Anthony and her two children in the Phoenix area. The bodies were found in 2005 in barrels at a Buckeye construction site.

The Arizona Supreme Court overturned the verdict in 2008. The court said the trial judge erred in letting the prosecution argue that David Anthony had a motive to kill his family.

He went back to trial in June.
