Family sues NYPD and cop over death of asthmatic girl

A dozen family members chanted for Briana Ojeda outside Brooklyn Civil Court on Friday. She died August 27, 2010. Her family says that Police Officer Alfonso Mendez refused to give the asthmatic 11-year-old CPR.

The family says the officer was instead giving the girl's frantic mother a ticket for driving the wrong way on a one-way street. She was heading to the hospital.

Officer Mendez eventually did put on his lights and sirens to escort the girl to the hospital, but it was too late.

He also allegedly said he didn't know CPR, according to reports.

On Friday, lawyers for the city asked the court to dismiss the Ojeda family's lawsuit against the police and Mendez.

The New York City Corporation Counsel spokeswoman issued a brief statement at our request: "We recognize the difficult and sensitive nature of the case. However since the matter is in litigation, we are unable to comment further."

The NYPD did respond to our request for comment.

In 60 days, Judge Sylvia Ash will rule whether to dismiss the Ojeda family lawsuit.

The Ojeda family also wants New York police officers to be required to give CPR.
