Disabled vet: I was arrested for selling I Love NY shirts

An advocacy group says that three Vietnam Veterans were arrested on Tuesday while selling I Love NY t-shirts at Battery Park in Lower Manhattan.

They were charged with trademark counterfeiting, according to the Street Vendor Project.

The veterans were allegedly handcuffed, taken to the First Precinct and held for five hours.

Larry Wagner, 67, a wheelchair-bound disabled vet who served three tours in Vietnam was among the three who were rounded up.

"I've been selling these same shirts for more than two years," Wagner said. "I had no idea they were counterfeit."

The famous I Love NY logo was designed by Milton Glaser in 1977.  It is trademarked by New York State as part of its tourism promotion effort.

"Tourists love these t-shirts, and street vendors - especially disabled veterans - should not be arrested for doing their part to promote our city and state," said attorney Sean Basinski, director of the Street Vendor Project at the Urban Justice Center.

Wagner says he got the shirts from a supplier in Brooklyn.

"I don't understand how we are supposed to know what is counterfeit," said Wagner.

The arresting officer is accused of leaving Wagner's wheelchair behind. Wagner claimed he was not allowed to call his wife, who became concerned when he did not arrive home at his normal time.

Wagner will be back in court on July 25, 2012 to fight the charges.

Fox 5 News is waiting for a response from the NYPD on the incident.
