Fox 29 has obtained court records from Montgomery County, Pa., that show Kate Gosselin filed for divorce on Monday and is represented by lawyer Cheryl L. Young.
Jon Gosselin is the defendant and had no legal representation.
Kate Gosselin filed in Montgomery County, which is adjacent to their Berks County home, because divorce records are sealed there.
She also released a statement to People magazine on Tuesday which said Jon’s “activities” forced her to file for divorce.
"Over the course of this weekend, Jon's activities have left me
no choice but to file legal procedures in order to protect myself
and our children," Kate said in a statement sent to People on
Monday night.
"While there are reasons why it was appropriate and necessary
for me to initiate this proceeding, I do not wish to discuss those
reasons at this time, in the hope that all issues will be resolved
amicably between Jon and myself. As always, my first priority
remains our children."
Jon Gosselin also has his own statement.
"This afternoon, Kate filed for divorce. Our kids are still my number one priority. I love them and want to make sure they stay happy, healthy and safe. My job is being the best, most supportive and loving father that I can be to my kids, and not being married to Kate doesn’t change that."
"This will be a difficult transition for all of us," Jon's
statement continued, "but Kate and I will work out a schedule that
enables our kids to have plenty of quality time with both of us at
home in Pennsylvania. In terms of my marriage, it’s no secret
that the past six months or so have been very difficult for Kate
and me. We are no different than other couples and parents who are
facing a crossroads in their marriage. I am of course deeply
saddened that we are divorcing."
On Tuesday morning, Jon wasn't saying much when Fox 29
spotted him on the family's expansive property Wernersville, Berks
County.
The father of two sets of multiples drove off in a black BMW with dark tinted windows shortly before 7 a.m.
A short time later, he reemerged with a man who appeared to be a security guard and flanked by Shoka and Nala, the two German Sheppards the Gosselins were shown adopting on an episode of the show.
Fox 29's Julie Kim asked if it was possible to continue filming there, and he said politely said no, before letting the security guard handle the rest of the conversation.
The guard asked the crew to leave their property, which apparently expands beyond a white fence at the end of their long driveway.
After weeks of speculation, the couple confirmed on Monday night's episode that they're officially splitting up.
“Kate and I have decided to separate,” Jon Gosselin said in the pre-recorded episode.
“I'm not very fond of the idea but I know it is necessary,” Kate Gosselin said. “I know it is necessary because my goal is peace for the kids.”
“The kids will remain in the house and Jon will be here when we flip flop days,” Kate said, who also said she would not be in the family's house when Jon was there.
“I'm in the show. We will film separately,” Jon said.
The TLC network promoted the one-hour show like a pay-per-view event, but People magazine spoiled the surprise by leaking the couple's divorce filing just hours before show time.
The couple appeared separately in pre-recorded sequences that were combined with images of their happy children playing.
Both Jon and Kate said they had been dealing with relationship problems for a long time.
“It's a total breakdown of everything,” Jon said of their current state.
There was no word on a divorce timetable.
